Disclaimer:

The original version of these Terms and Conditions (T&C) is written in German. This English translation is provided for convenience and reference purposes only. In the event of any conflict or discrepancy between the English translation and the original German text, the German version shall prevail and be legally binding.

Any legal disputes arising in connection with these Terms and Conditions shall be governed by the laws of Switzerland, with the exclusive jurisdiction being the courts of Zug. The court proceedings and all legal correspondence will be conducted in German.

Terms and Conditions (AGB)

1. Scope and Acceptance

These General Terms and Conditions (GTC) apply to all inquiries, offers, and contracts concluded via our website. By contacting us to submit an inquiry or offer, you agree to these GTC.

2. Offer, Order Process, and Contract Conclusion

2.1 Scope and Nature of the Offer

Our offers on this website are exclusively directed at customers residing in Switzerland. The displayed unique pieces and product descriptions are for inspiration and information only and do not constitute a binding offer to conclude a purchase contract on our part.

2.2 The Purchase Process

1. Inquiry Required: To express interest in a piece or to arrange a private viewing (online or in-studio), you must contact us directly using the provided contact information.

2. Binding Offer: Following your inquiry and/or a viewing, you may submit a binding offer to purchase the piece. This offer must be made in writing (e.g., via email).

3. Contract Conclusion: We reserve the right to accept or reject your offer. The purchase contract is only concluded when you receive a formal, written Order Confirmation from us (usually via email).

2.3 Client Confirmation and Review

By submitting your offer, you confirm that you are of legal age and legally competent to enter into this agreement. Please carefully check the details in our Order Confirmation (item description, price, pick-up/delivery details) and inform us immediately of any errors.

3. Prices and Payment Terms

3.1 Prices

All prices are stated in Swiss Francs (CHF) and include the applicable statutory Value Added Tax (VAT).

3.2 Payment Terms

Payment is accepted exclusively via bank transfer (Vorkasse).

Upon conclusion of the contract, we will provide you with the detailed payment instructions. The piece is considered sold and reserved for you only upon receipt of the full purchase price in our bank account.

3.3 Shipping Costs

Should shipping exceptionally be agreed upon with you for an inland delivery (as per Section 4), the agreed-upon shipping costs will be added separately and confirmed in your Order Confirmation.

4. Handover and Pick-up Policy

4.1 Studio Pick-up (Preferred Method)

For all orders, studio pick-up is the preferred method. After full payment is received, we will contact you to arrange a suitable date and time for pick-up at Studio-SB GmbH, Sihlbruggstrasse 3a, 6340 Baar, Switzerland.

4.2 Shipping for Inland Clients Only (Switzerland)

Shipping is not our primary method of delivery.

• If you are an inland client and studio pick-up is not possible, you must contact us directly before submitting your offer to discuss potential shipping arrangements.

• Delivery usually occurs via Swiss PostPac within Switzerland only, to the address provided by you (no parcel stations/pick-up points).

• The goods will only be shipped after full payment has been received via bank transfer.

4.3 International Clients (No International Shipping)

We do not offer international shipping. This includes the USA, Canada, and all other international destinations. Foreign clients who wish to purchase a piece must contact us directly before submitting an offer to confirm the possibility of a studio pick-up. Offers submitted by foreign clients that have not pre-arranged a studio pick-up will be cancelled.

4.4 Liability and Risk during Shipping

Delivery times are given to the best of our knowledge but are not binding. We assume no liability for delivery delays. The risk of transport passes to the client upon handover of the goods to the carrier. We are not liable for goods lost or damaged during transport. In such cases, please direct your claims to the shipping company.

4.5 Processing Fee for Non-Acceptance

If the goods are not accepted upon delivery or are returned, despite there being no right of return under these GTC and no warranty claim, the incurred costs plus a processing fee of CHF 40.00 will be charged.

5. Warranty and Quality

5.1 Statutory Warranty

The statutory provisions apply to defects in the delivered goods. Please contact us immediately if a product shows defects so that we can initiate further steps.

5.2 Quality Guarantee and Natural Materials

We place great emphasis on the quality and craftsmanship of our handmade products.

• Leather as a Natural Material: Full-grain leather naturally exhibits individual characteristics such as small blemishes, dents, scratches, or irregularities. These natural properties are not defects but are part of the leather's unique character. Slight variations in colour and structure may occur.

• Exclusion of Warranty: Excessive/improper use or treatment that leads to damage (such as incorrect cleaning or storage), as well as wear and tear due to the natural aging process of the leather, are excluded from the warranty. The warranty only applies when the goods are used properly.

• Reporting Obligation: Should a defect in workmanship or materials be present, we offer repair or replacement, provided the defect is reported within 7 days of receipt.

5.3 Care Instructions

It is the client's responsibility to follow the detailed care instructions provided for each product. Damages resulting from improper care or neglect are not covered by the warranty.

6. Liability

We assume no liability for slight negligence, indirect damages, consequential damages, or loss of profit. Our liability is limited to the purchase price of the goods in any case.

6.1 Liability for Errors in Personalization

The responsibility for the accuracy of all personalization details (e.g., monograms, design requests, sizing information) lies exclusively with the client. We assume no liability for errors in the personalization details after the order has been confirmed.

7. Right of Return / Withdrawal from the Purchase Contract

7.1 Exclusion of the Right of Return

A right of return does not exist for:

• Goods that have been custom-made or personalized according to the client's specifications.

• Items that have been specially ordered for the client (e.g., non-stock items).

• Goods that have already been used.

7.2 Right of Return for Standard Products (Thread, Hardware)

A right of return applies to goods such as thread and hardware that are in stock, provided the goods are returned within 7 days of receipt, unused, and in perfect, resalable condition (with all original labels and in original packaging).

7.3 Consequences of Withdrawal

In the event of an admissible withdrawal, we will refund all payments received from you, excluding delivery costs, without undue delay and at the latest within fourteen days from the day on which the returned goods were received by us. For this refund, we will use the same means of payment that you used in the original transaction.

7.4 Return Costs

The client bears the return shipping costs for goods being returned unless the returned goods are faulty or were delivered incorrectly (misdelivery).

7.5 Incorrectly Delivered Goods

Incorrectly delivered goods must be returned immediately by the client after prior notification to us. We will bear the resulting postage costs for the return.

8. Final Provisions

8.1 Data Protection

We treat your personal data confidentially. Further information can be found in our Privacy Policy.

8.2 Disclaimer for External Links

We expressly declare that we have no influence whatsoever on the design and content of the linked external websites and hereby dissociate ourselves from their content.

8.3 Severability Clause

Should any provision of these GTC be invalid, the remaining provisions shall remain unaffected. In such a case, the invalid provision will be replaced by a legally permissible regulation that comes as close as possible to the economic purpose of the invalid provision.

8.4 Place of Jurisdiction

The Cantonal Court of the Canton of Zug (6300 Zug) shall have jurisdiction over all claims related to the contractual relationship between the client and us. The court proceedings shall be conducted in German.
